Public Protector South Africa has declined a request to investigate President Cyril Ramaphosa over his alleged involvement in Minister Thembi Simelane’s loan scandal. The complaint, filed by Elias Muller, accused Ramaphosa of potentially acting dishonestly regarding his knowledge of Simelane’s R575,600 loan from Gundo Wealth Solutions prior to her appointment as a deputy minister.
Public Protector Advocate Kholeka Gcaleka stated that Muller’s complaint lacked sufficient evidence to proceed with an investigation, describing the allegations as “hearsay” without factual support. According to Gcaleka, other bodies, such as Parliament and law enforcement, are already examining the case, which makes further investigation by her office redundant. “A criminal case has also been opened on the matter,” clarified Public Protector spokesperson Khulu Phatiswa.
Muller Claims Unawareness of Investigation Outcome
Muller responded, saying he was unaware of the Public Protector’s decision to forego an investigation. He revealed that he received a confidential letter from the Public Protector’s office on November 5, 2024, requiring his response within five days. However, he refrained from disclosing details of the letter, citing the confidentiality terms of the Public Protector Act. Muller planned to submit his response before November 8, 2024.
In his initial complaint, Muller stressed the importance of investigating alleged “bullying” tactics used by the Presidency to pressure Simelane into issuing a press statement. The statement, reportedly denying any prior discussion with Ramaphosa about the loan, raised questions about transparency within the Presidency.
Muller’s concerns included whether Simelane was coerced by officials to publicly deny that she disclosed the loan to the ANC Integrity Commission before her appointment. Muller further sought an investigation into whether the President was aware of any pressure exerted by his office on Simelane.
Allegations Surrounding Simelane’s Loan and Gundo Wealth Solutions
The controversy dates back to Simelane’s previous role as Polokwane’s Executive Mayor, where she secured a R575,600 loan from Gundo Wealth Solutions, purportedly to open a coffee shop in Sandton. Gundo Wealth Solutions is owned by Ralliom Razwinane, who currently faces trial on charges related to fraud, corruption, and money laundering for his involvement in questionable investments, including links to the VBS Mutual Bank scandal.
The scandal has prompted ActionSA to file corruption charges against Simelane, which the Hawks are currently investigating.
Presidency Responds to Scandal’s Impact on Minister’s Department
Presidential spokesperson Vincent Magwenya commented that the Presidency remains confident that Simelane’s department remains unaffected by her previous financial dealings, adding that the issue was being handled appropriately. However, the allegations continue to cast a shadow over Ramaphosa, with critics arguing that his apparent awareness of the loan contradicts his request for a report on the matter.
The case’s prominence reflects growing public scrutiny of government integrity, as South Africa contends with numerous high-profile corruption cases. This latest development leaves unresolved questions about transparency and accountability within the country’s leadership.
