Telegram CEO Pavel Durov Charged for Child Sexual Abuse Images and Drug Trafficking Crimes on Messaging App

Pavel Durov, the CEO of Telegram, has been charged in France for complicity in the spread of child sexual abuse images and drug trafficking on the platform. Prosecutors accuse Durov of enabling criminal activities by refusing to cooperate with authorities, making the messaging app a hub for unlawful transactions.

Durov, aged 39, was detained at Le Bourget airport near Paris after disembarking from a private jet. He spent four days in custody before being released on bail set at €5 million (around R100 million), with a condition forbidding him from leaving France.

Telegram’s Lack of Cooperation with Authorities

French prosecutors revealed that Telegram had been repeatedly cited in cases involving crimes against minors, drug trafficking, and online hate. Paris Prosecutor Laure Beccuau stated that the app’s executives, including Durov, demonstrated a “near complete” lack of response to legal cooperation requests. This led the French organised crime unit, JUNALCO, to launch an investigation into the possible criminal liability of Telegram’s top officials.

The situation in France mirrors similar frustrations voiced by authorities in Belgium, who also reported difficulties in getting Telegram to assist in criminal investigations.

Telegram’s Defence and Durov’s Libertarian Stance

In response to the allegations, Telegram defended Durov, stating that neither the platform nor its executives should be held accountable for how criminals misuse the app. In a statement released on Sunday, the Dubai-based company argued that it fully complies with European laws. The company deemed the claims “absurd,” asserting that Durov has “nothing to hide” and is confident in resolving the charges swiftly.

Durov, known for his radical libertarian ideals, has cultivated a reputation for resisting government regulations. His approach to governance on Telegram has helped the platform grow but has also drawn criticism for its lack of moderation, which makes it an attractive tool for criminals.

Legal Troubles and Potential Trial

Although Durov has been charged, a criminal trial could take several months, or even years, to begin. If the trial proceeds, Durov’s legal team will challenge the findings. The charges he faces carry a maximum sentence of 10 years in prison.

Durov’s resistance to government intervention is a significant part of Telegram’s appeal to its users. However, his ongoing legal battles could mark a turning point for the platform, potentially pushing it towards more stringent content moderation.

Implications for Tech Platforms and Crime

This case brings to light the growing debate over the responsibilities of tech companies in preventing their platforms from being used for criminal activities. As governments globally grapple with how to regulate platforms like Telegram, this case could serve as a precedent for holding tech executives accountable for their role in the spread of illegal content.
